Wrongful Death

Wrongful death is the term applied to lawsuits involving wrongful conduct that results in death . Like personal injury, a "wrongful death" lawsuit can occur in almost any area of tort law, including premises liability, product liability, medical malpractice and automobile accidents.

In a wrongful death action, the surviving family members bring a lawsuit on behalf of the person who died. Families may be entitled to recover damages for medical costs incurred, funeral and burial expenses, the loss of love, companionship, services and society of the person who died, as well as the value of the earnings the decedent would have earned if he or she lived.
